We want all our customers to be completely satisfied with Tomorrow’s Stars Basketball.

We therefore recommend you read our refund and cancellation policies prior to paying for any service, so you are familiar with our policies and your rights under the Australian Consumer Law.

Terms And Conditions – School Holiday Basketball Camp

Terms and Conditions
All parents, guardians and carers (“Persons”) confirm that they have read and agree to these Terms and Conditions.  These Terms and Conditions govern Our relationship with you.  Please contact us if you have any questions about these Terms and Conditions.  For the purposes of these Terms and Conditions (“Our / We/ Us/ TSB”) means Brett Rainbow t/a Tomorrow’s Stars Basketball (ABN 46 732 461 162).

  1. Places will be filled on a first come first served basis.
  2. Payment of the deposit or payment in full will secure your booking.
  3. The Person who completes the registration  form has requested that the child named in the form (“the Child”) be enrolled in the TSB activity stated in the registration form.
  4. By accepting these Terms and Conditions, the Person represents to TSB that the Person is the parent or legal guardian of the Child, and that all information supplied to TSB is accurate and complete. 

Authorisations given to TSB

  1. The Person gives permission for the Child to participate in the TSB activity as described.
  2. The Person confirms that the enrolment of the Child in the TSB activity will not violate any existing court or parenting order, and that to the extent that it is necessary to do so, TSB has been given details of any such order.
  3. The Person confirms that they have given TSB all of the Child’s relevant health and medical information.

Medical issues and Emergency Care

  1. If the Child is unwell, or suffering from an infectious disease, the Child should not attend the TSB activity, in which case the cancellation policy will apply.
  2. The Person authorises TSB to administer medical assistance to the Child in the event of an emergency, and to call an ambulance if TSB representatives deem it necessary to do so, the cost of which is to be borne by the Person.
  3. If the Child has special needs you must contact Us prior to enrolling the Child in the TSB activity to discuss the Child’s requirements.
  4. TSB will not administer medications to the Child other than in an emergency.  If the Child must take medication during the TSB activity the Person must make appropriate arrangements.

Attendance at the activity

  1. The Person must ensure that on the day of the activity the Child brings the items stated on TSB’s website.  Food is not provided by TSB unless expressly stated. When packing food for the Child the Person should be mindful of other children that may have allergies and avoid packing foods such as nuts.
  2. The activity will operate between the hours stated.  The Person should ensure that the Child is accompanied by an adult until the Child is registered with a TSB representative.  The Child must be collected within 15 minutes of the finish time.
  3. No discount will be provided if the Child does not attend for the full duration of the TSB activity.
  4. TSB has the right to remove a Child from participation in the TSB activity if the Child is misbehaving and not following the lawful direction of TSB representatives.  The Person must arrange for the Child to be collected as soon as possible, if asked to do so by a TSB representative.  TSB reserves the right to suspend a Child from further participation due to the Child misbehaving.
  5. The Child must abide by TSB’s behaviour rules, which are:
  6. to comply with the directions and instructions given by TSB representatives;
  7. follow any signs and directions displayed at the activity venue;
  8. to behave in a way so as to not disrupt other children; and
  9. only consume food and beverages in designated areas.

Image release

  1. The Person authorises TSB and its representatives to take appropriate photographs and video footage of the Child during the TSB activity which may be used for marketing purposes.  The Child will not be identified by name in any photographs or video footage used by TSB.  The Person must notify TSB if they do not authorise TSB under this clause.
  2. The Person waives any rights and claims, present and future, to any fees or royalties or other benefits, in connection with TSB’s use of the Child’s image other than as expressly provided in the clause above.

Limitation in Liability

  1. To the extent permitted by law, TSB is not liable to the Person or the Child or any third party for any loss, damage or personal injury, arising in connection with the services provided by TSB. For the avoidance of doubt, this extends to employees, contractors, agents and representatives of TSB.
  2. Clause 19 does not apply to the extent that the injury, property damage or loss suffered by the Child is caused by the negligence of TSB or its representatives.
  3. The Person releases TSB from any liability arising at law in connection with loss or damage suffered by the Child or the Person as the result of the conduct of any third party, including another Child or adult (other than a TSB representative) attending the activity.
  4. To the extent permitted by law, TSB excludes all warranties implied by law unless expressly stated in these Terms and Conditions.  For the avoidance of doubt, TSB does not warrant any specific results can be achieved by the Child by attending the TSB activity.


  1. The Person indemnifies and agrees to keep TSB indemnified against all liabilities, costs and expenses which TSB may incur as a result of the Child or Person causing loss or damage or injury to another Child or Person in attendance at a TSB activity.

Pricing and Payment

  1. Prices are displayed on the TSB website, in Australian Dollars.
  2. The Person agrees to pay the price displayed on the website for the TSB activity.
  3. Payment is required to be made in full at the time of enrolling the Child unless otherwise stated by TSB.


  1. The Cancellation Policy for TSB Camps is as follows:
Date TSB is given notice of the cancellationPolicy

Up to the date of the camp, including non-attendance at the camp.Fees are forfeited
  1. In the unfortunate event that TSB needs to cancel a TSB activity all funds paid to TSB will be refunded.


  1. If extenuating circumstances arise and the Child is unable to attend the TSB Camp TSB may offer the Child a full or partial credit to attend the next TSB Camp.
  2. If the credit is not used towards the next TSB Camp, or extended to another TSB Camp by agreement with TSB, the Person will be refunded the value of the credit.


  1. TSB may offer free merchandise with enrolment in a TSB activity.  At the time of enrolling the Child in the TSB activity, the Person must nominate the Child’s clothing size.  TSB will order merchandise based on the information provided by the Person and accordingly, other sizes will not be available at the time of attending the activity. 
  2. If the Person has questions about the sizing of merchandise please contact TSB before selecting a size.


  1. TSB may assign its rights and obligations under these Terms and Conditions upon provision of 30 days’ notice to the Person.
  2. The unenforceability of a provision of these Terms and Conditions does not affect the enforceability of any other provision.  If a provision is void, voidable or unenforceable, it shall be taken to be severed from these Terms and Conditions.
  3. A waiver of any provision of these Terms and Conditions, or consent to a departure from a provision of these Terms and Conditions must be in writing and agreed to by TSB and the Person and is only effective to the extent for which it is given.
  4. These Terms and Conditions can only be changed or modified by agreement between the Person and TSB, documented in writing.
  5. These Terms and Conditions are governed by and are to be construed by and take effect in accordance with the laws of Victoria Australia.  Any disputes in connection with these Terms and Conditions will be heard in the jurisdiction of the Victorian Courts and Tribunals.

Terms and Conditions – Private Training

Expiration Date

  • Customers have 12 months from the purchase date to use their credit or sessions do expire. It is completely up to the customer to book sessions and use credit available.
  • If for whatever reason the customer can’t use credit available, they must contact Tomorrow’s Stars Basketball 1 month prior to the expiry date to discuss.


  • Bookings cancelled within 24 hours prior to the training session will incur a 100% charge
  • Bookings cancelled 24-48 hours prior to the training session will incur a 50% charge
  • If there is a last minute emergency and you need to cancel, you must contact a Tomorrow’s Star Basketball staff member directly on the phone to discuss the situation.
  • These situations will be dealt with on a case to case basis.


  • All purchases are final and under no circumstance will a cash refund be issued, only credit
  • There are no refunds or credit relating to inability to complete services or non-attendance

Terms and Conditions – Basketball Tours

Package Prices

  • The quoted amounts outlined in the package are in Australian dollars unless stated otherwise and will remain unchanged regardless of changes in currency exchange rates, fuel prices and taxes prior to the tour commencing.
  • The quoted price considers a minimum number of paying participants.
  • Please be aware that a new quote may be issued along with surcharges or a single supplement may be applied in case of under occupancy or where additional activities/expenses are added to the tour.
  • The tour group will be informed of any additional added expenses above the initial quoted price prior to or at the departure briefing.
  • Costs are subject to the group travelling together, any variation request by tour participants will incur an amendment fee.

Refunds and Cancellations

  • Tomorrow’s Stars Basketball collect a $1,200.00 deposit to reserve the date and time slot for our USA Basketball Tour and that the deposit is non-refundable unless the tour is cancelled by Tomorrow’s Stars Basketball.
  • If the customer cancels their tour, they forfeit their full deposit.
  • Tour cancellations made by member(s) of the touring party must be in writing to Tomorrow’s Stars Basketball prior to the tour commencement.
  • Your cancellation will be effected from the day Tomorrow’s Stars Basketball acknowledges receipt of your cancellation notice.
  • The table below outlines the scale of charges for cancellations. Please note that as the departure date becomes closer more of the tour is paid for and therefore less of a refund is available.

Period before departure % of tour charged:

  • Prior to 6 Months $2,000.00 per person
  • 6-4 Months 60%
  • 4-2 Months 80%
  • 2-Departure 100%

Cancellation Conditions

  • Upon tour commencement, no refunds will be provided including any unused portion of the tour.
  • After airline tickets have been issued, any cancellation levied by the airline will be in addition to the above.
  • All cancellations will take a minimum of 10 weeks to be processed.
  • The cancellation policy will be strictly adhered to and any appeals will need to be in writing to the Managing Director.
  • If the reason for your cancellation is covered under the terms of your insurance policy, you may be able to claim these charges from your insurance company.

Cancellation by Tommorrow’s Stars Basketball

  • Tomorrow’s Stars Basketball reserve the right to cancel a tour if the minimum required number of participants is not met.
  • In the event that Tomorrow’s Stars Basketball should have to cancel a tour, all deposits and installments will be refunded.

Terms and Conditions – Dunk Champ Jump Program

Code Of Conduct

24 Hour Rule

Under no circumstance is a parent or player to approach the Tomorrow’s Stars Basketball coaching staff to raise a negative issue until at least 24 hours after the game, training session or program. The aim is to allow time to reduce emotions and add perspective to a situation. The issue is still addressed but with a calmer approach, after giving the coach time to reassess. Most issues that blow out of proportion have arisen after a parent, usually, approached the coach negatively straight after the game, training session or program. By using the 24 hour rule both the coaches and the families understand the appropriate time to raise their concerns. It is also a rule not to discuss court time with families as it leads to discussions regarding other players in the team. This is not appropriate in itself (coaches should not be discussing John, with the parents of Billy etc). If parents want to discuss how their child can improve the discussion is welcome. That can be dealt with and as the player improves, generally speaking, so does the court time. COURT TIME IS ALLOCATED AT THE DISCRETION OF THE COACH

Parents and Guardian Code of Conduct

As a parent or guardian you agree to abide by the following Code of Conduct whilst involved with any program ran by Tomorrow’s Stars Basketball.

  • Encourage your children to participate for their own interest and enjoyment, not yours
  • Encourage children to always play by the rules. Teach children that an honest effort is as important as a victory.
  • Respect the rights, dignity and worth of every person.
  • Focus on developing skills and playing the game.
  • A child learns best by example. Applaud good play and efforts by all teams.
  • Do not criticize your child or other’s children in front of other people.
  • Accept the decisions made by referees as being fair and called to the best of their ability.
  • Conduct yourself in a dignified manner relating to emotions, language, attitude, actions and punctuality.
  • Support all efforts to remove verbal and physical abuse from sporting activities.
  • Co-operate with all coaching staff involved in your child’s development and support their decisions.
  • Show appreciations for volunteer coaches, officials and administrators.
  • Keep children in your care, under control
  • Always respect the use of facilities and equipment provided.

Player Conduct

As a player you agree to abide by the following Player Code of Conduct whilst being a part of any program ran by Tomorrow’s Stars Basketball.

  • Respect the rights, dignity and worth of fellow players, coaches, officials and spectators.
  • Conduct yourself in a dignified manner in regard to emotions, language, attitude, actions and punctuality.
  • Accept with good grace the decisions of all referees and game officials.
  • Maintain high personal behaviour and standards at all times, so as not to damage the reputation of Tomorrow’s Stars Basketball, your team, your school or your club.
  • Care, respect and wear your uniform with pride.
  • Care for and respect any equipment provided to you from Tomorrow’s Stars Basketball as part of your involvement in the program.
  • Co-operate and respect the decisions made by the coaching staff involved in your development.
  • Be honest with all coaches concerning illness or injury and your ability to practice fully within the program requirements.
  • Work equally hard on your individual development and the development of your team.
  • Play by the rules.

Coaches Code of Conduct

As a Coach for Tomorrow’s Stars Basketball you agree to abide by the following Code of Conduct

  • Display control, professionalism and respect the rights, dignity and worth of every person you have contact with during the implementation of the program including; opponents, other coaches, officials, administrators, parents, players and spectators.
  • Conduct yourself in a dignified manner relating to emotions, language, attitude, actions and punctuality at all time so as not to damage the reputation of Tomorrow’s Stars Basketball.
  • Refrain from general physical contact with players. Any physical contact must be appropriate to the situation and necessary for the player’s skill development.
  • Develop team respect for the ability of team mates and opponents as well as for the judgement of referees, officials and opposing coaches.
  • Follow the advice of a parent or physician/physiotherapist when determining whether a sick/injured player is ready to recommence training or playing.
  • Ensure that equipment and facilities meet safety standards and are appropriate to the age and ability of the players.
  • Ensure the intensity and scheduling of training programmers take into consideration the age and developmental stage of each team.
  • Be aware of and understand the role of the coach as an educator. Therefore, promote desirable personal, educational and social behavior.
  • Seek to keep abreast of the latest coaching practices and principles and to continually strive to professionally develop yourself. Take advantage of any opportunities that may enhance my skills and knowledge. Ensure that any information used is up to date and appropriate to the needs of the players, whilst taking into account the principles of growth, strength and development of children.

Terms and Conditions – Competitions

Terms and Conditions

  • Instructions, prizes and information on how to enter form part of these conditions of entry. By entering, entrants accept these conditions of entry.
  • The Promoter of this competition is Tomorrow’s Stars Basketball “Tomorrow’s Stars Basketball”. ABN is 46732461162, address: PO Box 923, Torquay, Victoria, Australia 3228
  • Tomorrow’s Stars Basketball reserves the right to change the Terms and Conditions, prizes and prize fulfillment method at any time.
  • Entry is open to residents of Australia only. Employees, relatives of employees and any stakeholders connected to Tomorrow’s Stars Basketball are excluded from being able to win prizes.
  • How to enter: Purchase or enrol in any Tomorrow’s Stars Basketball program. Participant in any Tomorrow’s Stars Basketball social media promotion. Entries are unlimited.
  • How to win: Winner is determined by the Promoter in its absolute discretion at the close of the promotion. There will be one winner selected in Australia.
  • Prizes: Tomorrow’s Stars Basketball endeavor to supply the winner a place on their USA Basketball Tour 2019 including economy return flights to Los Angeles, accommodation in los Angeles and Hawaii, 1-day Disneyland pass, 1 NBA game ticket, 1 college game ticket.
  • The promotional period will commence on Wednesday 27th February and will close at 5pm (AEDT) on Saturday 13th July 2019.
  • The winner will be notified via email or social media post on 14th July 2019. Winners have 24 hours to respond to Tomorrow’s Stars Basketball before the next runner up will be contacted. (Selection date with be up to Tomorrow’s Stars Basketball discretion)
  • In the event that the winner is unable to be contacted within 24 hours, unclaimed prizes will be dealt with as prescribed by the law of Victoria, Australia. The prize remains the property of the Promoter until claimed by the winner(s). The Promoter may conduct further selection as necessary in order to distribute any unclaimed prize.
  • The Promoter’s decision on all aspects of this competition is final and no additional correspondence will be entered into.
  • The Promoter reserves the right to verify the validity of entries and the identification of entrants. The Promoter reserves the right to disqualify any entrant for tampering with the entry process or for submitting an entry that is not in accordance with these conditions of entry.
  • The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained relating to the prize except for any liability which cannot be excluded by law.
